Introduction

These Terms and Conditions govern your use of Fleuve Doré's vehicle services in Montreal and along the St. Lawrence corridor. By engaging our services or accessing our website, you accept and agree to be bound by these terms. Please read them carefully before arranging any transportation.

If you do not agree with any part of these terms, you should not use our services or website.

Definitions

"Services" refers to the distinguished vehicle collection access, professional navigation, and transportation coordination provided by Fleuve Doré along the St. Lawrence corridor and Montreal region.

"User," "you," or "Client" refers to any individual or entity engaging with or using Fleuve Doré's services.

"Company," "we," "us," or "our" refers to Fleuve Doré, operating from Montreal, Quebec.

"Agreement" refers to these Terms and Conditions together with any service arrangement documentation.

"Content" refers to text, images, information, and materials available through our services and website.

Use of Services

Our vehicle collection services are available to individuals and organizations requiring refined transportation in Montreal and along the St. Lawrence corridor. When arranging services, you agree to provide accurate information regarding your transportation requirements, schedule, and contact details.

Age Requirements: All clients arranging vehicle services must be at least 25 years of age and hold a valid driver's license when applicable. For professionally navigated services, clients must be 18 years or older.

You are responsible for maintaining the confidentiality of any account information and for all activities that occur under your arrangements with us.

Prohibited Uses

You may not use our services for any unlawful purpose or in any way that violates these terms. Specifically, you agree not to:

  • Violate any applicable laws, regulations, or ordinances in Quebec or Canada
  • Use vehicles for illegal transportation of goods or substances
  • Engage in reckless operation that endangers persons or property
  • Sublease or transfer vehicle access without written authorization
  • Misrepresent your identity or provide false information during arrangements
  • Interfere with vehicle tracking or safety systems
  • Use services to harass, abuse, or harm other individuals
  • Attempt unauthorized access to our operational systems or data

We reserve the right to refuse service or terminate arrangements if we believe these terms are being violated.

Vehicle Access and Responsibility

When accessing vehicles from our distinguished collection, you accept full responsibility for the vehicle's condition during the arrangement period. This includes fuel management, parking compliance, toll payments, and maintaining the vehicle in the condition provided.

You agree to report any incidents, damage, or operational concerns immediately to our Montreal coordination team. Vehicle modifications, smoking, and pet transportation require advance written approval.

Professional navigation services include dedicated coordination but do not absolve clients of responsibility for personal conduct and adherence to traffic regulations.

Payment Terms

All services are priced in Canadian Dollars (CAD). Payment is required in advance for weekly vehicle access arrangements and may be structured as deposits with final settlement for extended engagements.

We accept major credit cards, bank transfers, and corporate billing arrangements. Payment timing is specified in your service agreement and must be honored to maintain vehicle access.

Prices may be adjusted with reasonable notice for future arrangements. Current arrangements are honored at agreed rates. Additional charges apply for extended durations, route modifications, and special requests as outlined in service documentation.

Applicable taxes, including Quebec Sales Tax (QST) and Goods and Services Tax (GST), are added to all service fees as required by Canadian tax regulations.

Cancellation and Refund Policy

Cancellations made with more than 72 hours notice before the scheduled arrangement receive full refunds minus a 15% administrative fee. Cancellations within 72 hours are subject to a 50% cancellation charge. Cancellations within 24 hours or no-shows result in full charge retention.

Weather-related cancellations initiated by our team receive full refunds or rescheduling without penalty. Client-initiated weather cancellations follow standard cancellation terms.

Refunds are processed within 10 business days to the original payment method. Weekly arrangement deposits are non-refundable but may be transferred to future dates within the same calendar year with advance coordination.

Special event transportation and peak season arrangements may have different cancellation terms as specified in your booking confirmation.

Intellectual Property

All content on our website and in our service materials, including text, graphics, logos, photographs, and software, is the property of Fleuve Doré or our content suppliers and is protected by Canadian and international copyright laws.

You may not reproduce, distribute, modify, or create derivative works from our content without explicit written permission. Limited use for personal reference regarding your service arrangements is permitted.

Photographs taken during professionally navigated journeys may be used by Fleuve Doré for promotional purposes unless you specifically opt out in writing.

Disclaimers and Limitations of Liability

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. While we maintain our vehicle collection to distinguished standards, we do not guarantee that services will be uninterrupted or error-free.

We are not liable for delays caused by weather conditions, traffic incidents, road closures, or other circumstances beyond our reasonable control. Professional navigation services represent best-effort routing based on current conditions and do not guarantee specific travel times.

Our liability is limited to the fees paid for the specific service arrangement in question. We are not liable for indirect, incidental, consequential, or punitive damages including loss of profits, data, or business opportunities.

You assume all risks associated with vehicle operation when accessing our collection independently. Professional navigation services maintain appropriate insurance but clients bear responsibility for personal conduct and adherence to traffic regulations.

Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or other matters where liability cannot be limited under Quebec law.

Insurance and Damage Responsibility

All vehicles in our collection maintain comprehensive insurance coverage as required by Quebec regulations. However, clients are responsible for deductibles and damages resulting from negligent operation, violations of traffic laws, or unauthorized use.

A security authorization is held on provided credit cards to cover potential damages, additional charges, or traffic violations. This authorization is released upon satisfactory vehicle return and resolution of any outstanding matters.

Clients must report all incidents immediately and cooperate with insurance documentation. Failure to report incidents may result in full financial responsibility for damages discovered after arrangement conclusion.

Termination

We may terminate or suspend your access to services immediately, without prior notice, if you breach these terms or engage in conduct we deem inappropriate or harmful to our operations, other clients, or our reputation.

You may terminate your service arrangement by following our cancellation procedures and returning vehicles in the condition provided, less normal wear appropriate to the arrangement duration.

Upon termination, all outstanding fees become immediately due. Provisions regarding liability, intellectual property, and dispute resolution survive termination.

Dispute Resolution

Any disputes arising from these terms or our services will first be addressed through good-faith negotiation between you and our Montreal management team. We aim to resolve concerns promptly and professionally.

If informal resolution is not achieved within 30 days, disputes may be submitted to mediation through a mutually agreed mediator in Montreal. Mediation costs are shared equally unless otherwise determined by the mediator.

Any legal proceedings will be governed by the laws of the Province of Quebec and Canada. You agree to submit to the exclusive jurisdiction of the courts located in Montreal, Quebec for resolution of any disputes.

Nothing in this section prevents either party from seeking injunctive relief in court for protection of intellectual property or confidential information.

General Provisions

Entire Agreement: These Terms and Conditions, together with our Privacy Policy and any specific service agreements, constitute the entire agreement between you and Fleuve Doré regarding the use of our services.

Severability: If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect. The invalid provision will be modified to achieve the intended purpose to the extent possible.

No Waiver: Our failure to enforce any right or provision in these terms does not constitute a waiver of that right or provision.

Assignment: You may not assign or transfer your rights under these terms without our written consent. We may assign our rights and obligations to another entity in connection with a merger, acquisition, or sale of assets with notice to you.

Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes become effective when posted on our website with an updated "Last Updated" date. We will make reasonable efforts to notify existing clients of material changes through email or account notifications.

Your continued use of our services after changes are posted constitutes acceptance of the modified terms. If you do not agree with modifications, you should discontinue use of our services.

Existing service arrangements are governed by the terms in effect when the arrangement was confirmed, unless changes are required by law or mutual agreement.
